Chris has advised and acted for, and against directors, who have been prosecuted by various regulatory authorities for breaching statutory provisions arising out of several statutes including the Companies Act, Taxation Administration Act, Health and Safety in Employment Act (refer to the section under Expertise on Workplace Health and Safety), Civil Aviation Act, Immigration Act, Fair Trading Act, Privacy Act and the Securities Act.
A number of statutes create both offences and crimes. In terms of the latter, the maximum penalties involved can be significantly higher, including lengthy jail terms. Chris has been successful in having statutory charges withdrawn in a number of prosecutions. It is important to note that not all statutory prosecutions are defendable, making it essential that all relevant matters are put before the Court to ensure that an appropriate sentence is achieved which is not too punitive for the defendant.
